Buying property in Almaty: a practical guide for foreign buyers

Start with your eligibility, then the property. This guide explains how to prepare a budget, organise viewings and document checks, and agree the route from a first offer to registration and handover. It focuses on buying a home as an individual, with separate questions for buyers living outside Kazakhstan.

Check your right to buy first

Kazakhstan’s general rule allows permanently resident foreigners to own housing, subject to applicable law and international treaties; it excludes temporarily staying foreigners from housing ownership. Have your nationality, residence status and any treaty position checked before paying a deposit. Official publication of the law on foreigners.

An IIN is an identification number, not a housing-ownership permission. A temporary residence permit is also different from permanent-residence status. These distinctions follow from the official IIN explanation and temporary residence guidance.

A home purchase does not replace the separate immigration approval process. Review the permanent-residence procedure before treating a purchase as part of your relocation plan.

If you are considering a house with land, check the parcel’s permitted use and location separately: foreign ownership is restricted for certain land categories and locations. Eligibility to buy a home does not establish eligibility to own every parcel. Land Code, Article 23.

Build a complete purchase budget

Set an overall limit and a separate target price for the apartment. Keep room for professional services, transaction expenses and the work needed before you can move in. If borrowing, discuss your individual eligibility and financing terms with the bank before making a time-sensitive offer.

Ask for the full cost in writing. For funds coming from abroad, discuss the transfer route and required supporting documents with your bank early; avoid making a completion promise before that conversation.

Check the seller and the property

Request the seller’s ownership basis, current registered-rights and encumbrance information, and technical property details. Match the owner, address and layout. Kazakhstan’s official purchase guide explains these checks.

Clarify whether there are other owners, minors or a representative, and have the required documents assessed: co-owner participation and children’s property. A power of attorney also needs a review of the authority it grants; checking its existence alone is insufficient.

Ask for an explanation of any mortgage, restriction, inheritance issue or layout discrepancy before negotiating the payment timetable. Keep a written list of unresolved points. Commission a technical specialist if the condition of the building or apartment raises concerns that a viewing cannot resolve.

Agree deposit terms before payment

A zadatok is a deposit with specific legal consequences and must be documented in writing. If the paying party is responsible for non-performance, the recipient keeps it; if the recipient is responsible, double repayment applies. Termination by agreement before performance, or impossibility without either party’s fault, requires repayment. Official deposit explanation.

Have the property, price, recipient, deadline and relevant conditions recorded. Explain any dependence on bank approval, your eligibility or the seller’s documents before signing. Ask what happens to the money if each condition fails. Do not assume an English label such as “reservation fee” tells you the legal effect of the agreement.

Signing, payment and registration

A sale may use a notarised agreement or simple written form; the latter involves the parties attending a public service centre for signature verification and registration. Discuss which route fits your case. Official purchase procedure.

Ownership arises on state registration. Signing the agreement or receiving keys does not replace that stage. Official registration explanation.

Agree the signing, payment, registration and handover sequence with your bank and transaction professional. Confirm the recipient, supporting payment records and what happens if a stage is delayed. Buying while outside Kazakhstan

A representative may need a notarised power of attorney with authority appropriate to the transaction. Confirm its wording and acceptance with the professional handling the purchase before arranging signatures abroad. Official explanation of powers of attorney.

Foreign-issued documents can require an apostille or consular legalisation and a Russian or Kazakh translation. Applicable treaties may remove the legalisation requirement. The route depends on the document and issuing country. Foreign Ministry guidance, treaty exceptions.

Ask separately what the notary, bank and registration process require from you. Do not plan travel around an assumption that every step can be completed remotely. Decide who inspects the apartment, checks the handover inventory and receives keys on your behalf.

New developments and handover

For a home in a building under construction, check the project’s lawful basis for accepting buyers’ funds. A reservation or preliminary sale agreement should not be treated as a substitute for a shared-construction agreement. Official new-development warning.

For handover, inspect the property again against the agreed inventory. Record condition, meter readings, keys, access cards and outstanding practical issues. Confirm the date the seller will leave and how charges up to handover are handled. If someone receives the apartment for you, agree the checklist and the evidence you want to see in advance.

Common questions

Does an IIN mean I can buy an apartment?

No. It is an identifier. Have your residence status and any applicable treaty assessed separately before committing money. See the eligibility section above.

Can I complete everything from abroad?

Do not assume so. Representation and foreign documents require advance checks, while the bank and transaction professionals may have their own process requirements. Confirm each step before arranging a remote purchase.

What should I send to start a search?

Your overall budget, preferred area, intended use, essential requirements and target timing. Mention your nationality, residence situation and whether you plan to use financing, so the relevant questions can be raised early.
